Research context

This research brief is designed for legal operations planning. Use the findings to ask better workflow questions, then test any proposed process against the firm’s jurisdiction, professional duties, systems, and client commitments.

What the metric can and cannot say

Acknowledgment metrics describe the administrative reach of a hold notice. They do not establish that a custodian preserved data, that the hold scope was adequate, or that the firm met its legal obligations. The method keeps those conclusions with counsel and measures the process that supports them.

Define the custodian population

Use the approved custodian list attached to the hold. Record the list version, the approval date, and the additions or removals since the last period. Custodians who left the company remain in the population with a note about the successor or the preservation arrangement.

Separate the events

Count notice sent, delivered, acknowledged, reminded, and escalated as separate events with dates. A delivery receipt is not an acknowledgment. An acknowledgment is not proof that the custodian preserved anything. Keeping the events separate prevents a single "compliance rate" from hiding the weakest stage.

Handle the denominator

Report the acknowledgment rate against the approved custodian list at the end of the period, not against the number of emails sent. If the list changed during the period, report the opening list, the additions, the removals, and the closing list so the denominator is reproducible.

Review the exceptions

List custodians with no acknowledgment, repeated reminders, a departure, or a disputed scope. Each needs an owner and a next action. Counsel decides whether to reissue the hold, contact the custodian directly, or take another preservation step.

Limitations

The method depends on accurate delivery and acknowledgment records, which email systems do not always preserve. It cannot see data deleted before the hold or preserved outside the approved systems. And it says nothing about the legal sufficiency of the hold notice itself.
